Terms And Conditions On The Event Of The Original Creator’s Death

License

These terms and conditions (“Agreement”) is a legal agreement between Aqwam Harish Aiman recognised as “Creator” and everyone involving the DataPredict Zero Library (or formerly known as Aqwam’s Derivative-Free Optimization Library) (“Library”) within this terms and conditions. This Agreement shall become effective and enforceable immediately upon the Creator’s death, and shall remain in full force and effect until terminated in accordance with its terms and conditions.

Defintions

  • The definition of “Beneficiary” are registered non-profit human health company or organization. The company or the organization must be involved in either human physical health, human mental health or both.

  • The definition of “Third Party” are any individual, company or organization who are not the Creator.

  • The definition of “Corrupted Entity” are any individual, company or organization that satisfies any of these conditions:

    • Have an ongoing criminal or civil court case involving corruption confirmed by a court of law.

    • Have a corruption criminal or civil court case involving corruption for the last 1825 days (equivalent to 5 years) confirmed by a court of law.

Grant Of Rights For The Beneficiary

  • The rights granted below are not exclusive to a single Beneficiary and is granted to all Beneficiaries if certain conditions are met.

Grant Of Rights Conditions For The Beneficiary

  • The Beneficiary must not be a Corrupted Entity.

  • The Beneficiary must not have a Corrupted Entity individual at any of the top-level leader status such as Chief Executive Officer, Chief Financial Officer, Chief Safety Officer, Chief Technology Officer and so on.

List Of Rights Granted To The Beneficiary By The Creator

Enforcement Rights

  • The Beneficiary have all the rights to enforce this Agreement’s and other “Terms And Conditions” violations on behalf of the Creator. All forms of compensations that are received by the Beneficiary as a result of enforcing this license must be used by the Beneficiary’s operations.

Commercial Rights

  • The Beneficiary have the right to sublicense the Library, provided that the amount of compensation must strongly benefit human individuals that are inflicted with physical health or mental health illnesses. The Beneficiary can use the Library’s existing commercial licenses made by the Creator as its own or for creating derivatives of these licenses. The compensation is confirmed to be strongly beneficial if the compensation leads to one of these conditions:

    • It leads to everyone’s medical costs subsidized by at least 5%, provided that the costs are similar to the market rates.

    • It leads to a large amount of patients having their medical costs subsdized by at least 10%, provided that the costs are similar to the market rates.

    • It leads to a medium amount of patients having their medical costs subsdized by at least 30%, provided that the costs are similar to the market rates.

    • It leads to a small amount of patients having their medical costs subsdized by at least 50%, provided that the costs are similar to the market rates.

    • It leads to a very large subsidy of a single patient that have very high medical costs throughout the patient’s treatment duration that could not be realistically paid by the patient, provided that the costs are similar to the market rates.

Grant Of Third Party’s Protection Upon Licensing From A Beneficiary

  • A Third Party who is validly licensed by one Beneficiary is not subject to enforcement actions by the other Beneficiaries for failing to also hold licenses from them.

Grant Of Rights By The Third Party

  • Upon the Third Party’s contributions to the Library, the Third Party agrees that all the rights are transferred to given to the Creator. The Third Party also agrees that these rights will not be revoked permanently, regardless of the time, cost, conditions and so on.

  • If the licensing Beneficiary is determined to be a Corrupt Entity, the license agreement shall be assigned from the corrupt Beneficiary to an alternative Beneficiary. The Third Party shall have 90 days to designate this alternative Beneficiary, on substantially similar terms. Failure to designate one within the 90-day period (equivalent to 3 months) will result in automatic termination of the license.

Upon The Revival Of Original Creator’s Life

  • In the extremely unlikely event of Original Creator’s revival in any form, the Agreement will be handled based on individual situations.

  • The revival of Original Creator can be from any cause or form, including:

    • Technological.

    • Spiritual.

    • Divine.

    • Others.

Valid Identity Conditions

  • For the Original Creator to satisfy having an “Valid Identity”, it must satisfy these conditions:

    • The revived Original Creator must have at least 10% of the Original Creator’s memories of any form, including:

      • Personal information.

      • Private information.

      • Public information.

      • Sensitive information.

      • Life history.

      • Academic knowledge.

      • Creative knowledge.

      • Hobby knowledge.

      • Significant knowledge.

      • Non-significant knowledge.

      • Others.

    • The revived Original Creator must have the ability to think and interact with the environment in any form (including physical and non-physical) without any external interference, except in cases for support.

Original Identity Conditions

  • For the Original Creator to satisfy having an “Main Identity”, it must satisfy all of these conditions:

    • Satisfies “Valid Identity” Conditions.

    • Satisfies “Non-Concurrent Existence” Conditions, which must satisfy one of these conditions:

      • All countries must have laws involving no replicates of “Original Identity”. In the absence of such laws for a specific country, the majority of that country’s population agreeing to no replicates of “Original Identity” or neutral to replicates of “Original Identity” overall can be a placeholder to that country’s law.

      • Only one revived Original Creator exists at the time of revival in the entire world.

  • If all of the conditions under this section are met, then the Agreement will be terminated immediately upon the Original Creator’s revival.

Secondary Identity Conditions

  • For the Original Creator to satisfy having an “Secondary Identity”, it must satisfy all of these conditions:

    • Satisfies “Valid Identity” Conditions, or must match 100% genetically.

    • Satisfies “Concurrent Existence” Conditions, which must satisfy one of these conditions:

      • One of the countries have any laws that are favourable towards replicates of “Original Identity”. In the absence of such laws for a specific country, the majority of that country’s population agreeing to replicates of “Original Identity” can be a placeholder to that country’s law. This condition can be superseded if there is more than one replicates of “Original Identity” exists in the entire world, regardless of difference in forms and memories.

      • More than one revived Original Creator exists at the time of revival in the entire world.

  • If all of the conditions under this section are met, then the Cloned Identity are given the same rights and conditions as the “Beneficiary”.

Handling Of Specific Scenarios

  • Should the first replication of the Original Creator results having an “Original Identity” status, the subsequent replications of the Original Creator results in having an “Secondary Identity” status. This means that the first revived Original Creator will always keep the “Original Identity” status due to lack of replications of Original Creator at the time of revival.

  • Each replication of Original Creator is assumed to have an “Original Identity” status unless it fails one of the conditions, provided that there are no other replicates of Original Creator exists in the entire world during the time of replication.

  • Only the “Original Identity” can create revived “Valid Identity”, “Original Identity”, “Secondary Identity”.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of a jurisdiction selected at the sole discretion of the Creator. In the absence of a choice by the Creator, the laws of Malaysia shall apply.

Entire Agreement

This Agreement constitutes the entire agreement between User and Creator with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between User and Creator.

In the event that any provision within this Agreement is found to be invalid, illegal, or unenforceable under any applicable law or by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect, and the invalid, illegal, or unenforceable provision shall be deemed modified to the extent necessary to make it valid, legal, and enforceable, preserving the intentions of the parties to the maximum extent possible.
