Terms And Conditions Enforcement Information

As a solo developer, we know that it takes a lot of money to actually sue a company for terms and conditions violation. However, most solo developers lack this money and time to deal with these violators, making it impossible for solo developers to gain fair revenue for their hard work.

As a result, I have crafted a primary strategy that does not require money upfront, but will certainly give me a good success rate should a violation is found.

This is how I structure the enforcement strategy to ensure that companies would comply with the DataPredict™’s Terms And Conditions.

Enforcement Strategy

  1. Advertise the bounty reward to the public.

  2. Once a whistleblower found a company that violates the terms and conditions, the whistleblower must contact me before making any actions towards the violating company. This is to evaluate the nature of violation, the amount of fees that can be recovered and so on. The larger the violating company’s revenue, the more likely it is worth it to build a case against this violating company.

  3. Once I determine that building the case for this company is worth it, the whistleblower is requested to give all the evidence of companies’ usage. This is for building an initial evidence to convince pro-bono lawyers to take this case.

  4. I will contact multiple pro-bono lawyers to review the whistleblower’s evidence. Once a pro-bono lawyer agrees to take this case, the whistleblower, the pro-bono lawyer and me will work together to maximize the likelihood of success. This includes:

    • The whistleblower gathering more evidence about the violation.

    • The pro-bono lawyer would instruct what evidence should be collected by the whistleblower.

    • Pro-bono lawyer would inform me which violation have occured according to the DataPredict™’s Terms And Conditions written by me and inform what actions I should take.

    • The process would repeat multiple times until the case is refined enough so that it leads to high likelihood of winning in court.

  5. The violators will most likely settle more than dragging it into a court case. If the violators choose to settle, it is very likely that the monetary payment will be based on the commercial licensing cost on top of additional costs for paying the pro-bono lawyer and the whistleblower.

The amount paid to the whistleblower would be based on DataPredict™’s Terms And Conditions Violation Bounty Reward Information.

Potential Whistleblowers

  • An unhappy employee of the violating company.

  • A company’s competitor.

  • Someone who wants to make a quick cash.
